As to your image appearing in the gallery, it is likely that someone saved it from your gallery and uploaded it the Smashly demo as a test. I will gladly take it down if you'd like...just let me know which image it is. This is one of the problems with allowing users to upload images...it is difficult to know if what they upload is their own or what the license the image was originally licensed under.
